Your TracePlay membership can be either a renewable, recurring offer; or a non-renewable, one-time offer, depending on the offer you choose among the offers available in your country. You can see the full list of offers available in your country at www.traceplay.tv
Should you choose the renewable, recurring offer, your TracePlay membership will continue until terminated or expired.
To use the TRACE Play service you must have an Internet access and a compatible device, and you must provide us with a current, valid, accepted method of payment, which you may update any time you wish ("Payment Method"). You can find specific details concerning your membership with TRACE Play by visiting the “My Account" section on the application.
You have the possibility to start your TracePlay membership with a free trial. This free trial period was set up to allow new and potential members to try the service before subscribing. The free trial lasts for the amount of time specified during sign-up and you will be notified during sign-up whether you are eligible for a free trial. Each user can benefit from a free trial once and only once.
You must provide us with a current, valid, accepted method of payment to be able to start your free trial ("Payment Method") which you may update from time to time in the section “My Account" on the service. Your Payment Method will of course not be billed during your free trial. Your Payment Method will be billed for your membership fee at the end of the free trial period for the corresponding TRACE Play membership unless you cancel your membership before the end of the free trial period. If you wish to find membership prices and ending date of your free trial period, please visit the “My Account" section on the service.
For renewable, recurring offers, the membership fee for the service can be billed on a weekly, monthly, yearly basis and/or on any other period-based basis depending on the TRACE Play membership plan that you’ve signed up for. It will be billed to your Payment Method at the frequency corresponding to the chosen offer. In some cases, the timing of your billing may change, for example, if your Payment Method is not successfully settled or if your paying membership began on a day not contained in a given month. Visit "Billing details" section in "My Account" to see your next payment date.
For non-renewable, one-time offers, the membership fee for the service is billed one time at the date of the purchase
Payment Methods: You can change your Payment Method anytime you wish by going to "My Account" section of the website. If a payment is not successfully processed, due to expiration of your payment method, insufficient funds, or otherwise, and you do not change your Payment Method or cancel your account, we may suspend your access to the service until we have obtained a valid Payment Method. You have to know that for certain Payment Methods, the issuer of your Payment Method may charge you a foreign transaction fee or other charges. Check with your Payment Method service provider for more details.
Cancellation: In case you have subscribed to a recurrent offer, you can terminate your TracePlay membership at any time, and you will continue to have access to the TracePlay service through the end of your billing period. Please note that we do not provide refunds or credits for any partial membership periods or unwatched Content. To cancel your membership, please procede to "My Account" page and follow the instructions for cancellation. If you terminate your membership, your account will automatically close at the end of your current billing period.
Changes to the Price and Service Plans : Please note that we may change our service plans as well as the price of our service and different offers from time to time; however, any changes will apply to you no earlier than 30 days following an email notice to you. If you do not agree to the said change, you can unsubscribe from TRACE Play service in "My Account" section.
You must be at least 18 years old, or the age of majority in your province, territory or country, to subscribe to a TRACE Play membership. Minors may only use the service under the supervision of an adult.
The TRACE Play service and any Content viewed through the service are for personal and non-commercial use only. For the duration of your TracePlay membership we grant you a limited, non-exclusive, non-transferable, license to access the TRACE Play service and you may view the Content on a streaming-only basis. Except for the foregoing limited license, please note that no right, title or interest shall be transferred to you. You agree not to use the service for public performances.
You may view the Content through the TracePlay service primarily within the country in which you have subscribed your account and solely in geographic areas where we provide our service and have licensed the Content. The Content available to watch will vary by geographic location and will change from time to time. The number of devices on which you may simultaneously watch Content depends on subscription you have chosen and is specified on "My Account" page.
We perpetually update the TracePlay service, including the Content. In addition, we continually test various aspects of our service, including our website, user interfaces and promotional features. We may change, suspend, or discontinue - temporarily or permanently - some or all of the Services (including the Content and the devices through which the Services are accessed), with respect to any or all users, at any time with no notice. You acknowledge and agree that TRACE Play may do so in TRACE Play's sole discretion. You also agree that TRACE Play will not be liable to you for any modification, suspension, or discontinuance of the Services and/or Content. You also agree that it is TRACE Play’s sole discretion to define the volume, duration and the availability of the Content for the Service.
You agree to use the TRACE Play service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions about use of the service or Content therein.
You agree not to: circumvent, alter, remove, deactivate, degrade or thwart any of the Content protections in the TracePlay service; use any robot, spider, scraper or other automated means to access the TRACE Play service; decompile, reverse engineer or disassemble any software or other products or processes accessible through the TracePlay service; insert any code or product or manipulate the Content of the TracePlay service in any way; or, use any data mining, data gathering or extraction method.
You agree not to upload, post and email or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the TracePlay service, including any software viruses or any other computer code, files or programs.
The quality of the display of the streaming Content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection. The minimum connection speed for SD quality is 250 kbps; however, we recommend a faster connection to benefit from the higher video quality. You are responsible for all Internet access charges. Please check with your Internet provider for information on possible Internet data usage charges.
The time it takes to begin watching any Content will vary based on a number of factors, including your location, available bandwidth at the time, the Content you have selected and the configuration of your TRACE Play ready device.
TRACE Play streaming software is designed to enable streaming of Content from TracePlay through TracePlay capable devices. This software may vary by device and medium, and functionalities may also differ between devices. You acknowledge that the use of the service may require third party software that would be subject to third party licenses. You acknowledge and agree that you will automatically receive updated versions of the TracePlay and related third-party software.
The member who created the TRACE Play account and whose Payment Method is charged (the "Account Owner") has access and control over the TRACE Play account. To maintain control over the account and in order to prevent anyone from accessing the account, the Account Owner should not reveal neither the password nor the Payment Method details (e.g., last four digits of their credit or debit card, or their email address if they use PayPal) associated with the account to anyone. You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account.
You should be mindful of any communication requesting that you submit credit card or other account information. Providing your information in response to these types of communications can result in identity theft. Always access your sensitive account information by going directly to the TracePlay website and not through a hyperlink in an email or any other electronic communication, even if it looks official. We can terminate your account or place your account on hold in order to protect you, TRACE Play or our partners, from identity theft or other fraudulent activity.
We will send you information relating to your account (e.g. payment authorizations, invoices, notices…) in electronic form only, for example via emails to your email address provided during registration. We may also send you news about TRACE Play, details about new features and content available on TRACE Play, special offers, promotional announcements and consumer surveys and/or other information related to the Service. You can always choose to unsubscribe from such communication by clicking on ‘unsubscribe’ at the bottom of the e-mail.
